1. Scope of the agreement
1.1. The Seller sells Products through the online Store at https://arttogo-shop.com/

1.2. By ordering Products through the Website, the User agrees to the Terms and Conditions for Sale of Products set out below (hereinafter – the Terms and Conditions for Sale of Products). In case of
disagreement, the User must immediately cease to use the service and leave the Website https://arttogo-shop.com/

1.3. These Terms and Conditions for Sale of Products, as well as the information about the Product
presented on the Website, are a public offer in accordance with article 633 of the Civil Code of Ukraine.

1.4. These Terms and Conditions may be changed or modified at Seller's discretion without notifying the User/Customer. The new version of the Terms and Conditions shall become effective from the moment of its publishing on the Website, unless otherwise specified.

1.5. Acceptance of this Offer is effective from the moment the Seller sends the Customer a confirmation email about Order acceptance when the Customer places an Order on the Website http:// The Contract for the Sale of Products shall be deemed to have been made from the moment the Seller issues the Customer a settlement document confirming payment for the Products or from the moment the funds are credited to the Seller's Bank account. When Visitor/User/Customer of the Website provides the Seller his/her e-mail and phone number, he/she agrees to the use of these means of communication by Seller or third parties engaged by Seller. Such personal data is used for fulfilling obligations to Visitors/Users/Customers of Website, sending promotional and informational messages containing information about discounts, upcoming and current promotions and other events of the Seller, about the transfer of the order for delivery, as well as other information directly related to the fulfillment of the obligations to Customer under this Public Offer.
2. Product and purchase procedure
2.1. The Seller ensures that the Products presented on the Website are available in its warehouse.
All Pictures shown are for illustration purpose only and may differ from the actual appearance of the
Product. The descriptions/characteristics of the Product are not intended to be exhaustive and may
contain typos. To clarify information about the Product, the Customer should contact us by writing an

2.2. In case if Products ordered by a Customer are out of stock, the Seller shall have the right to exclude a specified Product from the Order/cancel the Customer Order, notifying the Customer by sending a corresponding electronic message to the address specified by the Customer.

2.3. The Customer is fully responsible for providing incorrect information, which resulted in the Seller's inability to properly fulfill its obligations to the Customer.

2.4. After placing an Order on the http Website: https://arttogo-shop.com/
he Customer is provided with information about the expected delivery date through the email specified by the Customer. The Manager working with this Order specifies the details of the Order, agrees on the delivery date, which depends on the availability of the ordered Products in the Sellers warehouse and the time required for processing and delivery of the Order.

2.5. Manager of the Order notifies the Customer about the expected date of transfer of the Order to the delivery service by email or during a control call to the Customer.The date of transfer of the Product may be changed at Seller's discretion if, in the Sellers opinion, there is an external reason.
3. Delivery of the order
3.1. The Product is delivered by the postal operator in the form of a piece of mail with payment for a
Product on the checkout page of the Website or an electronic invoice for the Product by Bank card or
Bank transfer (including international one). Delivery methods: delivery services DHL express and FedEx or other services at the Seller's discretion in "Express" or usual mode. Specific delivery times can be agreed by the Customer with the Manager when confirming the Order.

3.2. The territory of delivery of Products presented on the Website is not limited to the borders of
Ukraine.

3.3. Delays in delivery are possible due to unforeseen circumstances that occurred through no fault of
the Seller.

3.4. Upon delivery, the Order is handed over to the Customer or a third party specified in the Order as
the recipient.

3.5. The risk of accidental loss or accidental damage to the Product becomes the Customer`s
responsibility from the moment the Order is transferred to him/her and the Recipient of the Order signs the documents confirming the delivery of the Order.

3.6. The cost of delivery for each Order is calculated individually, based on the Product weight, region,and delivery method at the last stage of Order placement.

3.7. The Seller's obligation to deliver the Product to the Customer is considered fulfilled when the Customer receives the Order, as it is determined in accordance with the current rules of postal
communication. The order of delivery and disclosure of items containing Products is determined by the current rules of postal communication.

3.8. When accepting an Order from a courier, the Recipient is obliged to inspect the delivered Product
and check it for compliance with the declared quality, assortment and completeness of the Product, as well as the the package integrity. If there are no complaints about the delivered Product, the Recipient signs the "Order Delivery Form". The signature in the delivery documents indicates that the Recipient has made no claims against the Products and the Seller has fulfilled its obligation to transfer the Products properly and fully.

3.9. The Manager who contacts the Customer to confirm the Order can give information about delivery date, time, and, if necessary, delivery route.

3.10. The User expressly agrees and understands that:
Delivery is a separate service that is not an integral part of the Product purchased by the Customer, and execution of this service ends when the Recipient receives the Product.

Claims to the quality of the purchased Product that arose after receiving and paying for the Product are considered iin conformity with the Law of Ukraine "About consumer protection" and the Seller's warranty obligations. In this regard, the purchase of Product with delivery does not give the Customer the right to demand delivery of the purchased Product for the purpose of warranty service or replacement; it also does not allow for warranty service or replacement of the Product by visiting the Customer's place and does not imply the possibility of a refund of the cost of delivery of the Product in cases where the Customer is entitled to a refund for the Product in itself, in accordance with the Law of Ukraine "About consumer protection".

– All goods purchased by Customer on the Website and sent outside of Ukraine may be subject to import taxes, fees, VAT and import restrictions in the destination country specified by the Customer. Settlement of such taxes and duties is the Customer's sole responsibility and their amount cannot be compensated by the Seller or calculated on the Website in advance.
4. Payment for the product
4.1. The price of the Product is indicated in UAH on the terms of CIP (INCOTERMS 2010) in the city of delivery to the Customer, unless otherwise specified in the invoice, and does not include value-added tax. If an Order is placed and the Product is subsequently sent outside of Ukraine, the price is indicated in the currency (US dollar or EURO), and does not include value-added tax.

4.1.1. The Order amount consists of the cost of the ordered Products.

4.2. The Product price is indicated on the Website https://arttogo-shop.com/ If the price of the Product ordered by the Customer is incorrect, the Seller informs the Customer about this to confirm the Order at the corrected price or cancel the Order. If it is impossible to contact the Customer, this Order is considered canceled.

4.3. Seller can change the Product price unilaterally. However, the price of the Product ordered by the
Customer is not subject to change.

4.4. Payment for the Product can be made:
If the Order is placed and then sent to the territory of Ukraine or abroad – in UAH by non-cash funds
before sending the Order in the amount corresponding to the Order amount specified in the email
including discounts. If the Order is placed and then sent to the territory of Ukraine or abroad – in UAH via Visa and Master Card credit cards before sending the Order in the amount corresponding to the Order amount specified in the email including discounts.

4.5. The Seller has the right to provide discounts on Products and set a bonus program. Types of
discounts, bonuses, the procedure and conditions for their acceptance are specified on the Website and can be changed by the Seller unilaterally.
5. Return of products and refund.
5.1. The Customer has the right to refuse the received Products and terminate the the Contract for the Sale within 14 calendar days from the date of receipt of the Products, excluding the day of purchase, except for the Products that are not subject to exchange and return in accordance with the Resolution of the Cabinet of Ministers of Ukraine No. 172 as of March 19, 1994 On the Implementation of Certain Provisions of the Law of Ukraine "On Protection of Consumer Rights with amendments and additions.

5.2. The Product subject to return shall have all seals and labels and shall be sent by Customer via mail to the address specified by the Manager in personal correspondence.

5.3. Return of Product of proper quality

5.3.1. Return of Product of proper quality is possible if the product has not been used, its marketable
condition, consumer properties, seals, labels, and the payment document has been saved.

5.3.2. If the Customer rejects the Product in accordance with clause 6.2.1. the Seller refunds the cost of the returned Product, except for the penalty for the Product rejection, which is determined by the Seller individually for each Order sent outside of Ukraine, within 30 days from the date of receipt of the returned Product at the Sellers warehouse, along with the Customers application for a refund. The cost of return delivery of the Product in the case of a refund is paid by the Customer. The cost of the Product is only refunded to the person specified in the Product Order, provided that such person provides a copy of his/her national passport and identification code. If the Customer specified incorrect data in the Order, or did not provide all the documents listed above for a refund, the Seller reserves the right to deny a refund to such a Customer.

5.3.3. If at the time of the Customer's request, a similar Product is not available for sale, the Customer
has the right to refuse to perform this Agreement and demand a refund of the amount paid for the
specified Product. The Seller must return the amount paid for the returned Product within 30 days from the date of return of the Product.

5.4. Return of Products of poor quality:

5.4.1. A Product of poor quality is a product that is defective and cannot ensure the performance of its
functional qualities. The received Product must match the description on the Website or in an email.
The difference in design or design elements from those stated in the description on the Website or in an email is not a sign of poor quality or lack of functionality of the Product.

5.4.2. The Recipient should check the appearance and completeness of the Product, as well as the
completeness of the entire Order at the time of delivery of the Product.

5.4.3. After receiving the Order, claims for external defects of the product, its quantity, completeness,
and appearance are not accepted.

5.4.4. If the Customer receives a Product of improper quality, and otherwise was not agreed in advance by the Seller, the Customer has the right to use the provisions of the Article 8 Consumer Rights in Case of Purchase of Goods of Improper Quality of the Law of Ukraine About Consumer Protection.

5.4.5. Claims for a refund of the amount paid for the products are subject to satisfaction within 30 days from the date of submission of the corresponding claim (paragraph 4 of article 12 of the Law of Ukraine About Consumer Protection).

5.5. The refund is made by returning the amount paid for the Product to the Bank card used to make the payment, or by Bank transfer, depending on initial payment method.

5.6. The warranty period for Products is set by the manufacturer and indicated on the label or tag. The Seller ensures proper use of the Products during the warranty period. The Seller is not responsible for defects in the Product if they occurred after its transfer to the Customer due to the Customer's inappropriate use or storage of the Product, actions of third parties, or force
majeure circumstances.
6. Responsibility
6.1. The Seller is not responsible for any damage caused to the Customer as a result of improper use of Products purchased through the Website.

6.2. The Seller is not responsible for the content and functioning of external resources.
7. Confidentiality and personal data protection
7.1. Users /Customer's personal data is processed in accordance with the Law of Ukraine No. 2297-VI On Protection of Personal Data dated June 01, 2010. The period of personal data storage and processing is 5 years.

7.1.1. The Seller carries the right to send informational messages, including advertising messages, to the Users /Customer's e-mail and mobile phone upon their consent. User/Customer carries the right to opt out of advertising and other information without explaining the reasons for this decision. Service messages informing the User/Customer about the order and its processing stages cannot be rejected by the User/Customer.

7.2. The Seller is not responsible for the information provided by the User/Customer on the Website in a publicly accessible form.

7.3. The Seller has the right to record telephone conversations with the User/Customer. At the same
time, the Seller undertakes the following: to prevent unauthorized access to information obtained
during telephone conversations and/or transfer it to third parties not directly related to the execution of
Orders, in accordance with the Law of Ukraine No.2657-XII About Information dated 02.10.1992.
8. Additional terms and conditions
8.1. The Seller may assign or otherwise transfer its rights and obligations arising from its relationship
with the Customer to third parties.

8.2. The Website and the services provided may be temporarily partially or completely unavailable due to maintenance or other work, or for any other technical reasons. The Sellers technical service has the right to carry out periodically the necessary preventive or other work with or without prior notice to the Customer.
8.3. The relationship between the User/Customer and Seller are subject to the provisions of the Laws of Ukraine.

8.4. In case of any questions or complaints, User/Customer must contact the Seller by phone or other
available means. The parties will try to resolve all emergent controversies through negotiations. If the
parties do not reach an agreement, the dispute will be referred to the judicial authority in accordance
with the current legislation of Ukraine.

8.5. If any part of this Agreement is judicially found void and unenforceable, it will not affect the validity of the remaining parts.
